Terms and Conditions

Scope and agreement

These terms govern this website and creative production services provided under the Bad Media name. Our services are intended for agencies and businesses. You must have authority to enter an agreement for any business you represent. An engagement begins when both parties accept a written proposal, order, or service agreement. Specific project terms take priority over these general terms, subject to mandatory legal rights and guarantees already promised.

Services and deliverables

Services may include strategy, ideation, scripting, production planning, video editing, motion graphics, captions, variations, quality checks, revisions, and delivery. Only the services and deliverables in your accepted proposal are included. Filming, additional concepts, source files, and extra formats require agreement where not already included.

Your responsibilities

Provide accurate briefs, usable materials, necessary access, and timely feedback and approvals. You must have the rights needed for us to use supplied materials, including relevant copyright permissions, music licenses, appearance releases, and your clients’ permissions. Review factual statements, product claims, offers, and required disclosures before publishing. We remain responsible for our own contractual and legal obligations.

Timelines and revisions

Your agreement sets the start date, delivery schedule, and included revisions. Missing inputs or an approved scope change may require a documented timeline adjustment. We will communicate material delays. Revisions adjust work within the agreed brief; new directions or deliverables may require an additional quotation. We obtain approval before charging for extra work. Our advertised 14-day guarantee is addressed in the Refund and Cancellation Policy.

Fees and cancellations

Your proposal or invoice specifies fees, currency, applicable taxes, deposits, and payment deadlines. Recurring charges require advance agreement to renewal and cancellation terms. If payment is overdue, we may pause work after written notice and a reasonable opportunity to resolve it. Cancellations and refunds follow our Refund and Cancellation Policy.

Intellectual property

You retain ownership of supplied materials and permit us to use them as needed for your project. Once amounts due for a final custom deliverable are paid, we assign to you the rights we own in that deliverable, except for pre-existing tools, templates, reusable assets, and third-party materials. We grant the license needed to use any incorporated pre-existing materials for the agreed purpose. Third-party assets remain subject to their licenses; we will identify material restrictions. Editable files, raw files, and unused concepts are included only if expressly agreed.

Confidentiality and portfolio use

Both parties must protect confidential project and business information, sharing it only as needed for the engagement or as legally required. We will obtain written permission before using your name, logo, project materials, or completed work in our portfolio or marketing.

Advertising outcomes

We provide creative production services with reasonable care and skill. Campaign performance also depends on targeting, spend, offers, landing pages, and platform decisions. We do not guarantee views, leads, sales, platform approval, or return on advertising spend unless expressly agreed in writing. This does not reduce our production commitments or advertised guarantee.

Acceptable use and termination

Do not use the website or our services to infringe rights, distribute unlawful or deceptive content, introduce malicious software, or access systems without permission. We may refuse unlawful work. Either party may end an engagement for a material breach that remains unresolved after notice and a reasonable opportunity to correct it. We will account for work, outstanding fees, deliverables, and any refund under the agreement. Applicable confidentiality, payment, and intellectual property provisions continue after termination.

Responsibility and disputes

Each party remains responsible for its breach of the agreement and applicable law. Nothing excludes liability or remedies that cannot legally be excluded. Please contact us so we can try to resolve concerns in good faith. Any governing-law or court-selection provision must be stated in your project agreement and is subject to mandatory protections. These terms do not restrict legal remedies available to you.

Privacy, changes, and contact

See our Privacy Policy for information about personal data. Updated terms apply to future engagements; they do not retrospectively change an existing agreement without agreement or legal authority. For questions or requests, contact Bad Media on Instagram or use the contact channel provided in your project agreement. You can also schedule a call. Please do not send sensitive personal information in an initial message.
